TERMS & CONDITIONS
Auctions By: Simnitt Brothers herein after referred to as the Auctioneer.

All items are sold AS IS, WHERE IS with no warranty, expressed or implied. The Auctioneer shall not be responsible for the correct description, authenticity, genuineness, or defect in any lot and makes no warranty in connection therewith. No allowance, refund or set aside will be made on account of any incorrectness, error in cataloging, imperfection, defect or damage. Any descriptions or representations are for identification purposes only and are not to be construed as a warranty of any type. Sellers have the right to remove any item or items at any point before the auction ends. The Auctioneer will not be held liable for the Sellers removal of any item or items.

The Auctioneer is acting as Agent for the Seller and all representations made by Auctioneer are made on behalf of the Seller. The Auctioneer is not responsible for the acts or representations of the Seller. Any action or recourse will be directed to the Seller and not to the Auctioneer.

REGISTRATION: To bid online, the Online Auction Registration Form must be completed before the online auction item closes. Click here to register for our Online Auction site. Once Online Registration has been approved, you can use the username and password for all online auctions on our Online site.

If you register and bid at an Online Auction and then attend the Live Auction you will need to register to bid at the Live Auction. BE AWARE THAT YOUR ONLINE BIDS WILL BE EXERCISED BY THE ONLINE ADMINISTRATOR YOU ARE WELCOME TO BID IF YOU ATTEND BUT IT IS YOUR RESPONSIBILITY TO REMEMBER WHAT YOU HAVE BID ON AND THE AMOUNTS OF THE BID AS WELL AS THE MAXIMUM AMOUNT YOU HAVE BID ON ANY ITEMS.

Live Auction registration is held during preview times that are usually 1 to 2 hours before the auction starts.

ONLINE BIDDING: After Completion of the Online Registration Form and being approved you are ready to bid. The Online Bidding concludes before the Live Auction Starts, check each Online Auction for the Online Auction closing time

You can enter two types of Bids Online one the initial bid and then a maximum bid (which is the bid you are willing to go up to) if desired. Bids are only accepted in standardized bidding increments as listed below.

ONLINE BUYERS PREMIUM: A buyer’s premium of 10% shall be added to each purchase on the total sales price.

ONLINE WINNING BIDDER NOTIFICATION: The Online Buyer shall be notified within one (1) day after completion of the auction. The Online Buyer shall then communicate with Auctioneers Online Adminastrator within two (2) days of the completion of the auction.

TOTAL SALES PRICE: The total sales price of an item includes (1) the hammer price of the item (2) the buyer's premium (3) applicable sales and other taxes due on account of the sale, (4) packing, shipping transportation and insurance charges, and customs fees and charges and duties, if applicable, and (5) any other amount due from the Buyer. Buyer may be charged tax based on the laws and regulations in the state where the Auction is located.

BIDDERS RESPONSIBILITY: As a Bidder, placing a bid is a binding contract between you and the Owner/Seller and the bid cannot be retracted. Once you place a bid, and if you win, you will be obligated to buy the product at the said price you indicated as your bid. Placing a bid on this Site, and winning, then not paying for the product is illegal, and prosecution can result. The Auctioneer/Owner/Sellers of property sold through this Site reserve the right to reject any and all bids, in their sole discretion. Only the laws of the State of Kansas shall apply and shall govern all actions accordingly. Buyer agrees to abide by all such Kansas laws.

As a Bidder you are responsible for any bids placed under your bidding number and password. The security of your Bidder information is your sole responsibility as you, the Bidder, will be responsible for any and all bids placed under your number. If at any time you feel that your Bidder number and password have been compromised due to lack of security on your part you must notify Auctioneer immediately.

Bidder agrees that when using the Maximum Bid feature on the Site, you use it according to the specifications Auctioneer has in place for that feature. When using the Maximum Bid feature, if you are the current high Bidder and you want to change your Maximum Bid, you will be required to place a new bid in the increment designated for that item/lot in order to raise your Maximum Bid, which may cause you to raise your last high bid by one bid increment. You, as a Bidder, agree to only use this feature if you understand how the Maximum Bid feature works.

Stored items are not covered by our insurance and must be stored at the owners risk.

PAYMENT DUE: Auctions by Simnitt Bros., Inc. will charge the credit card on file for the total purchase price plus the buyers premium at the conclusion of the auction unless other arragements have been made prior to the date of the live auction. Title shall pass to the Buyer within 10 business days of the live auction. Purchaser shall bear all responsibility and expense of picking up vehicles purchased. SALE TERMS: All items in the catalog are sold as described by the Seller of the item. No statement regarding condition, kind, value or quality of a lot shall be construed to be an expressed or implied warranty, representation or assumption of liability by Auctioneer or Seller

Statements made day of sale take precedence over anything previously stated, printed, or published.

DISPUTES: The Buyer agrees that any and all disputes arising from an auction will be resolved solely through binding arbitration in Shawnee County, Kansas.
